1. GENERAL CONDITIONS
By accessing and placing an order on mitracbd.com you accept and agree to be bound by these terms and conditions. Do not continue to use mitracbd.com’s services if you do not accept all of the terms and conditions stated on this page. Mitracbd.com reserves the right to change these terms and conditions at any time without prior notice. Such change however will have no effect on orders that were submitted before posting of such revised terms and conditions on mitracbd.com.
These terms apply to all users of mitracbd.com, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content. We reserve the right to suspend mitracbd.com at any time for operational, regulatory, legal or other reasons. We may terminate your use of mitracbd.com immediately if you breach any of these terms.
The following terminology applies to these Terms & Conditions, Privacy Statement and Disclaimer Notice and any other agreements on mitracbd.com: “Client”, “You” and “Your” refers to the person accessing mitracbd.com and accepting the terms and conditions. “The Company”, “Ourselves”, “We”, “Us”, “Our” and “Store” refers to our company. “Party” and “Parties” refers to both the Client and mitracbd.com. You agree that it is your responsibility to monitor changes to our site.
6. PLACING AN ORDER
6.1 For placing an order on mitracbd.com you must be 18 years of age or over, be accessible by phone and have a valid email address.
6.2 To place an order on mitracbd.com, add the desired item/items into your shopping card.
6.3 After doing so, go to your cart and proceed to checkout. The website will guide you through the process.
6.4 If you have an account and logged in, you can continue. If you do not have an account yet, you can create one.
6.5 Choose the payment method and finally you can complete the order.
6.6 When you place your order, mitracbd.com will issue you an Order Number.
6.7 mitracbd.com will send your order confirmation to you by email.
6.8 If you wish to add any items onto your original order, please place a new order via our website. Depending on the chosen delivery charge may be applied, which we are unable to refund. These items will arrive separately to your original order and we’re unable to combine the orders together.
7. PRICES, PAYMENTS & INVOICING
7.1 The product prices on cbdshoplinbe.com are updated and changed frequently.
7.2 All prices include VAT. and in EUR.
7.3 Prices shall be those prices published on mitracbd.com at the time you submit your order. The total price stated on the order form you submit shall be the total amount payable by you for the products including shipping.
7.4 If, by mistake, we have underpriced a product, we will not be liable to supply that product to you at the stated price, provided that we notify you before we despatch the product to you. In those circumstances, we reserve the right to cancel your order. In the event we cancel your order, we will give you a full refund on any amount already paid for that product in accordance with our return and refund policy.
7.5 You may pay for your products by the methods of payment as may be displayed at checkout.
7.6 If you are paying by credit or debit card, then you must supply your credit or debit card details when you place your Order. Mitracbd.com will not supply the products to you until your credit or debit card issuer has authorised the use of your card for payment of the products ordered. Mitracbd.com reserves the right to verify the identity of the credit or debit card holder by requesting appropriate documentation.
7.7 When your order is confirmed, you will receive the invoice to your email address after delivery of the package. The invoice is provided with information about the price and all costs relating to the purchase.
7.8 The buyer is obliged to check the accuracy of the information before placing an order. Later, given the objections as to the correctness of invoices issued are disregarded.
8. DISCOUNT CODES & COUPONS
8.1 From time to time we offer promotional discount codes or coupons which may apply in respect of any, or certain specified, purchases made through mitracbd.com.
8.2 The conditions of use relating to any discount code will be specified at the time of issued. We reserve the right to remove promotional/discount codes at any time and without prior warning.
8.3 Promotional codes and coupons can’t be exchanged for money.
8.4 Only one promotion code or coupon can be used per order.
8.5 Some products are excluded from all discount or promotional codes as these already retail at a discounted price.
8.6 A promotion code or a coupon can’t be used after an order has been placed.
9. DELIVERY & SHIPPING
9.1 Mitracbd.com will deliver the products ordered to the delivery address you have specified in the order form with the delivery option you have chosen.
9.2 Any shipment dates given by mitracbd.com are best estimates only and mitracbd.com shall not be liable for any loss, damage, costs or expenses for failure to deliver in accordance with the delivery or shipment dates given.
9.3 Upon delivery of the products to the carrier, mitracbd.com will send you a confirmation email.
9.4 All orders placed and paid by credit card until 12.00 (from Monday to Friday), are packed and shipped the same day. Orders that are placed and paid on the weekend are shipped on the first workday.
10. RETURNS & REFUNDS
10.1 Within fourteen (14) working days, the customer has the right to report (info@mitracbd.com) to withdraw from the contract without having to state a reason for its decision. The deadline shall commence one day after the date of acquisition.
10.2 The only cost to the customer for the cancellation of the contract is the cost of returning the goods. Although you will have to pay the cost of returns, the refund will include the full value of the product. Goods must be returned within 14 days of the filed notice of withdrawal.
10.3 If a product was supplied in error, is incomplete or faulty and you believe that you are entitled to a replacement, please email to info@mitracbd.com.
10.4 If you noticed upon the delivery that the item or consignment is physically damaged, it lacks content, or is showing signs of opening, you can file a compensation process for the carrier.
10.5 In the case of a withdrawal, where a discount code or promotional code was used, these assets are considered as a discount and will not be returned to the user. The user will only be refunded the amount paid.
10.6 Repayment of payments will be made as soon as possible, but no later than 30 days from the receipt of the notification of withdrawal.
10.7 IMPORTANT! – The customer must return the product/products to the seller undamaged and seal the packaging securely. If the original packaging is damaged or the product/products has been used, the user will not be refunded for returns.
11. LIABILITY
11.1 These terms and conditions set out the full extent of our obligations and liabilities in respect of the supply of the products and the performance of any services.
11.2 Nothing in the contract shall limit or exclude our liability for death or personal injury caused by our negligence or for fraud or any breach of the obligations implied by applicable compulsory national laws as to title or any liability which cannot be excluded by law.
11.3 There are no warranties, conditions or other terms that are binding on mitracbd.com regarding the supply of products except as expressly stated in the contract.
11.4 Any warranty, condition or other term arising out of or in connection with the supply of products and/or the provision of services which might otherwise be implied into or incorporated in the contract by statute, common law, laws applicable in the country where you purchased the products or services or otherwise is hereby expressly excluded to the maximum extent permitted by law. In particular, mitracbd.com will not be responsible for ensuring that the products are suitable for your purposes.
11.5 This does not affect your statutory rights as a consumer, nor your right to return the products.
12. CIRCUMSTANCES BEYOND REASONABLE CONTROL
Mitracbd.com will make every effort to perform its obligations under the contract. However, it cannot be held responsible for delays or failure to perform if such delay or failure is caused by any circumstances beyond our reasonable control. In the event of a delay, we will perform our obligations as soon as reasonably possible.
13. STATEMENT ON PRODUCT DESCRIPTIONS
All information on mitracbd.com is only informative and in no way intended as a substitute for the advice of a treating physician or other healthcare staff, nor can it be compensated for proper medical care, since it is not recognized by health authorities. Products and claims about individual products on mitracbd.com have not been evaluated by state institutions and are not intended to treat or prevent illness. If you are taking other medicines and other dietary supplements, consult your doctor before combining these with CBD infused products.
14. STATEMENT ON LEGAL STATUS OF PRODUCTS
Mitracbd.com does not take any responsibility for damages caused by the delivery, transport and customs clearance of ordered items. Customer agrees, that he/she inquired information about the legal status of the products in the country where the customer is ordering from. Mitracbd.com does not have documents that would explicitly explain the legal status of products in certain countries.
15. LEGAL NOTICE
All the information on mitracbd.com is protected and can not be reproduced or used without prior written permission.
16. DISAGREEMENTS GOVERNING LAW & JURISDICTION
Mitracbd.com will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement and you want to take court proceedings, you must do so within the courts of Germany. The applicability of the United Nations Convention on Contracts for International Sale of Goods is hereby explicitly excluded.
